Independent Contractor Disclaimer

This Independent Contractor & Employment Status Disclaimer is issued by Rekindle Looks Inc, doing business as Fleet Rise Logistics (“Fleet Rise”).

1. No Employment Relationship

Fleet Rise does not employ motor carriers, owner-operators, or drivers.

All carriers and drivers using Fleet Rise services operate as independent contractors or independent business entities.

Nothing on this website or in Fleet Rise services shall be construed to create:

• An employer–employee relationship
• A joint employer relationship
• A partnership or joint venture
• A principal–agent relationship beyond limited dispatch authorization

2. Carrier Independence

Each carrier retains exclusive control over its business operations, including:

• Hiring, training, and supervision of drivers
• Payment of wages, benefits, and taxes
• Work schedules, routes, and driving decisions
• Equipment ownership, leasing, and maintenance
• Compliance with federal and state transportation laws

Fleet Rise does not direct how transportation services are performed.

3. No Wages or Benefits

Fleet Rise:

• Does not pay wages, salaries, or commissions to drivers
• Does not withhold payroll taxes
• Does not provide health insurance, workers’ compensation, or other employment benefits

All compensation arrangements exist solely between the carrier and its drivers.

4. No Control Over Means or Methods

Fleet Rise does not:

• Control driver hours
• Assign routes
• Require specific driving behavior
• Supervise deliveries
• Require acceptance of any load

Load acceptance is entirely voluntary and at the carrier’s discretion.

5. Regulatory Classification

Carriers are responsible for their own classification under federal and state law.

Fleet Rise makes no representations regarding:

• Independent contractor classification
• ABC test compliance
• IRS classification
• State labor law status

Carriers are encouraged to consult their own legal or tax advisors.

6. Indemnification

Carrier agrees to indemnify and hold harmless Fleet Rise from any claims, liabilities, penalties, or damages arising from:

• Employment classification disputes
• Wage or hour claims
• Tax or benefits claims
• Claims by drivers or third parties asserting employment status

7. Incorporation by Reference

This Disclaimer is incorporated into and forms part of Fleet Rise’s:

• Terms of Service
• Dispatcher–Carrier Agreement
• Dispatcher Disclosure & Regulatory Notice
